Terms & Conditions

Welcome to the H.Samuel online precious metals recycling service. Please read these "Gold Buying" Terms & Conditions carefully before submitting your application form.

In these Terms & Conditions

"Goods" means the gold or precious metal you submit for valuation to us. Please bear in mind that we will only provide a valuation for items which are listed on our website under the What We Buy section. A list of these items will also be included in any Gold Buying pack we send to you.

"We" and "us" means H.Samuel Limited.

"You" means the person selling the Goods. Our Gold Buying service is available exclusively to individuals and is not open to anyone in business. Individuals must have their place of residence in the United Kingdom and have a UK bank account.

"The contract is agreed" means when you have accepted by email or by phone our offer to purchase your Goods at our proposed price and on the basis of these Terms and Conditions only. We may make an offer to purchase your Goods by phone or by email which, if accepted by you, will result in a binding contract.

By submitting an application form for us to purchase your Goods, you confirm that you are at least 18 years old and that you are the owner of the Goods you wish to sell to us.

Application form and dispatch of the Goods

After you have completed our online "Gold Buying" application form, within 2 working days we will send you a Gold Buying pack containing our full instructions, a detailed form for you to complete, the necessary packaging to dispatch your Goods and a postage paid return envelope.

We want to ensure that your Goods reach us safely. Therefore we strongly recommend that you use the postage paid envelope included in your Gold Buying pack and do not send us any Goods other than through Royal Mail Special Delivery service which provides insurance up to a value of £500. If you use another postal service (or if you believe the value of your Goods exceeds £500), we would strongly recommend that you ensure that the parcel has the right level of insurance in relation to the value of the Goods you are sending. We are not responsible if your Goods are lost or damaged in the post or are not received by us.

You will need to make sure that your Goods are carefully wrapped to avoid any loss or damage in transport. We may reject any envelope or package which has been opened, damaged or tampered with and will return these to the sender. If the envelope has been damaged or tampered with, we will use our best endeavours to advise you of this on receipt, however we are not responsible for any loss or damage occurring while the Goods are in transit to us.

Selling your Goods

Certain steps must be followed before a contract is agreed. These steps are described below.

We will value your Goods on receipt by us of your completed Gold Buying pack. Where we decide to make an offer to you, we will do so within 3 working days of receipt of your Goods and will inform you by the preferred method (phone or email) you have indicated on your completed form. If you have not expressed a preference we will contact you by phone.

We are under no obligation to make an offer to you. If upon valuation, we discover that the Goods have no resale value, then provided we have notified you of this, we reserve the right to dispose of the Goods at our discretion, without any compensation being payable to you. Where we otherwise decide not to make an offer to you, we will return what we have received from you at no cost to you.

The price we offer for your Goods is valid for a period of 48 hours from the time at which we made the offer to you, that is the time of our phone conversation or the time at which we sent our email offer to you.

We will not purchase any of your Goods if we cannot contact you to notify you of our offer and in this case we will return what we have received from you at no cost to you, unless where, as stated above, the Goods have no resale value, in which case we reserve the right to dispose of the Goods at our discretion, without any compensation being payable to you.

Once you have accepted our offer to purchase your Goods, a contract is agreed and you will not be able to get your Goods back. We intend to recycle your Goods immediately after the contract is agreed.

In order to carry out our valuation, a small scraping will be taken from the Goods and acid will be applied to this scraping to determine the gold carat. If following valuation we return your Goods for any reasons, there may remain a slight noticeable mark on the Goods but it will be possible to polish this out. We will not have to compensate you or make good the damage that may have been caused by scraping the Goods in the valuation process.

If it becomes apparent to us that you are not the owner of the Goods you have sent to us, we may at any time, before or after the contract is agreed, at our choice, either return to you the Goods we have received or return the Goods (or the equivalent price) to their true owner. If we return the Goods (or the equivalent price) to the true owner of the Goods, we should not be responsible to you for returning the Goods or paying the equivalent price.

Tracking receipt by us of your Gold Buying pack

You will be able to track and trace whether we have received your Gold Buying pack by logging onto Royal Mail Track and Trace service at: http://postcode.royalmail.com/portal/rm/track?catId=22700601.

Cancellations

If you change your mind after sending your Goods to us, you can withdraw your request for a valuation at any time before you agree to our offer to purchase your Goods. Please see below for our telephone number. You will need to give us your name and address details, as well as your tracking reference number to cancel your request for a valuation. In this case we will return your Goods at no cost to you.

Pricing and payment

Prices quoted on our website and on the phone are quoted in Pounds Sterling and we will only make payment to you in Pounds Sterling. The prices provided to you on the website through our online gold calculator are only provided as an estimate and will not constitute an offer from us to buy your Goods at this price. Prices for Goods may vary daily.

We will only proceed to make an offer on the basis of valuations of the Goods sent to us in one package not exceeding £2,500 and reserve the right to refuse to make an offer to purchase if the contents of a single package exceed £2,500. The maximum amount in value of Goods that we are willing to consider per individual per household may not exceed £10,000 during a 12-month period.

The price we will pay to you is the price agreed between us. If a pricing error is made on our website or during our valuation we will inform you as soon as possible and give you the option of selling the Goods to us at the price at which we correctly value them or to withdraw from the process.

Payment from us will be by a cheque in your name to be posted within 5 working days from the date the contract is agreed to the address you have indicated in your Gold Buying pack. Please note that we will only send payment to a UK address.

We may also, at our discretion, give you the option to receive payment by a gift card, to be posted within 5 working days from the date the contract is agreed to the address you have indicated in your Gold Buying pack. For the terms and conditions relating to the issue of gift cards, please see:

Please note that we cannot send the cheque/gift card to another address than the address you have indicated in your Gold Buying pack. We cannot make the cheque out to anyone other than you.

Changes to the Gold Buying - Terms & Conditions

We reserve the right to change these Gold Buying - Terms & Conditions from time to time. If this happens, we will notify you by displaying the new Gold Buying - Terms & Conditions on the H.Samuel website or by inserting the revised terms in the Gold Buying pack we will be sending to you. If you do not wish to be governed by the revised Gold Buying -Terms & Conditions, you must not complete our application form.

These Gold Buying - Terms & Conditions are governed by the law of England and you and we agree to use the English courts if there is any dispute between us. If any part of these Gold Buying -Terms & Conditions is found to be invalid by law, the rest of them remain valid and enforceable.
